General Sales Conditions

1. Accepting General Sales Conditions
These General Sales Conditions govern contractual relations between LAMBEY SA and the Online Store customer on the www.lambey.com site
In making an order the customer accepts all of these General Sales Conditions.
They take precedence over all other conditions set out in any other document in the absence of express exemption by us. 
LAMBEY SA reserves the right to change these General Sales Conditions at any time.

2. Products
LAMBEY SA has total independence in selecting the products offered in its Online Store. 
Product photographs are not contractual.
LAMBEY SA reserves the right to add or delete products in its catalogue at any time without prior notice.

3. Product Availability
Products will be sent out within 2 working days except in the case of an event of force majeure or any event occurring on its premises

4. Prices
Prices shown on the www.lambey.com site are in Euros
All prices are shown Net of VAT and VAT Inclusive
Prices shown in your order summary are VAT Inclusive
These prices include the total cost of the order with details for each product. 
There are no additional shipping costs.
LAMBEY SA retains title to the products until payment in full.

5. Orders
Ordering on the www.lambey.com site online store takes place at the time that the customer pays for their order.
In addition to accepting the content of their order, customers declare that they have full capacity to contract to these General Sales Conditions and this represents full acceptance of them and constitutes proof of the date on which the order is made. At the time of making their order, customers are to supply the following information at their sole liability:

Email address.Surname and first name
. Address (street number)

. Town
. Post Code
. Telephone number
.The possibility of having products delivered to an address which is different to that on the invoice

LAMBEY SA confirms acceptance to the customer of their order by email to the address entered by the customer. In paying by credit card a sale is only considered as having been completed at the point of acceptance on the secure Crédit Agricole area and confirmation of the order by LAMBEY SA. In paying by bank cheque, a sale is only considered as having been completed upon receipt of cheque by LAMBEY SA. LAMBEY SA reserves the right to refuse or cancel any new order from a customer with whom there is an existing dispute.   Data recorded on the LAMBEY SA computerised information systems constitutes proof of all transactions made between LAMBEY SA and its customers. The customer has, prior to making their order, read the essential characteristics of the product(s) which they wish to order on the internet site.
Customers make their orders at their sole liability based on their needs and are the judge of the compatibility of the products ordered with their purpose and it is the customer's responsibility where they believe that they do not have sufficient competence to do so, to take advice in making their choice.

6. Delivery

Product delivery to the address provided by customers will either be carried out by LAMBEY SA itself or by a carrier.
LAMBEY SA alone has the right to choose the method of carriage. In the event of error in the recipient's address details, LAMBEY SA will not be liable where delivery is impossible. Customers are notified by email when goods depart from LAMBEY SA premises and notified by telephone by the carrier to organise delivery to the customer. Delivery area: The delivery area comprises mainland France and Belgium. The following are excluded from the delivery area: Corsica, French overseas territories and foreign countries not included above. Where the customer is not present at the time of delivery resulting in products being returned to LAMBEY SA, the costs of returning the products and associated costs will be payable by the customer.
Delivery and carriage times set out in the order are seven (7) working days.
LAMBEY SA will not be obliged to deliver in the case of an event of force majeure or any event occurring on its premises or to LAMBEY SA's service suppliers
Your order is checked in our factories before delivery.
LAMBEY SA strongly advises you to check your delivery with the carrier. 
Where there are missing or damaged goods, customers are to follow the following procedures:
1/ Keep the package and product in their current state.
2/ Write detailed delivery acceptance reservations on the Delivery Order supplied by the carrier
3/ Customers are to inform LAMBEY SA by telephone on +33 (0)3.85.72.31.65 which will then trigger claim proceedings with the carrier.


7. Payment by credit card and Securing Payment


Payment for products is in full on the actual order date. Prices are shown on the order confirmation sent to customers by LAMBEY SA. Payment may be made by credit card: Visa, MasterCard, other Carte Bleue (credit card) or by cheque
The secure Crédit Agricole payments system is used by the LAMBEY SA online store.
This is the most secure system for transactions made on SSL (Secure Socket Layers) Internet.
At the time of payment by credit card, customers leave the www.lambey.com site and enter the Crédit Agricole bank site accessible via secure https protocol.
Information requested from customers relating to their credit cards is therefore only supplied to Crédit Agricole. The transfer of information is fully protected by coding. LAMBEY SA will not receive information relating to customers' credit cards at any time.
A customer's order will not come into effect until the payment centre has authorised it. In the event of refusal by Crédit Agricole orders will be automatically cancelled. 
Data recorded on the LAMBEY SA information systems constitutes proof of all transactions made between LAMBEY SA and its customers.

8. Liability

Customers have a legal warranty for latent defects in products sold under the general conditions of Articles 1641 to 1649 of the Civil Code. LAMBEY SA will not be liable for any consequences in the use of its products, users being fully responsible for their use.

9. Applicable law

These General Sales Conditions are subject to French law.

10. Jurisdiction

Customers and LAMBEY SA will always seek an amicable solution before any legal proceedings.


11 . Protection of personal data

Personal information collected from customers is necessary for processing orders, sending them out and drawing up the related invoice. Where this information is not provided orders will be refused.
In order to comply with "Personal Data Protection" Act, processing of customers' personal information is subject to declaration to the French National Commission for Data Protection the Commission Nationale de l'Informatique et des Libertés (CNIL).
Pursuant to Article 34 of the law dated 6 January 1978 customers have the right to access, change, correct and delete data relating to them.
